The Bribery Act 2010 received the Royal Assent on the 8th April 2010. The Act came into force on 1st July 2011.

Lombard Chambers is delighted to offer a Bribery Act compliance package which provides a complete compliance solution to the direct and indirect obligations imposed on UK businesses by the Bribery Act 2010. The Act creates four new offences of bribery and is a complete restatement of the current law. It is only by adopting adequate procedures, that a commercial organisation has a defence to the new offences created under the Act, such as failure of a commercial organisation to prevent bribery (Section 7 Bribery Act).

The Bribery Act contemplates that a business (either a company or partnership) will be held criminally responsible for the criminal activities of its agents (defined by the Bribery Act as “Associates”) unless the business can demonstrate it has in place adequate procedures to prevent bribery by its agents, employees or professional advisors (collectively “associates”). “Adequate procedures” is not defined by the Act. The Secretary of State has issued Guidance as to procedures which can and should be put in place to prevent or reduce the risk of bribery.

It follows that the most important aspects of compliance will be the Risk Assessment. It is only by properly conducting this exercise that a business can implement proportionate procedures. The solution is to provide an online step by step training package for risk assessment and implementation.

The training package includes: Compliance Officer Training, Advanced Training and a Basic Training course.

The emphasis of Compliance Officer Training is practical guidance; however the training course also provides a detailed section on the new law, together with numerous practical examples. The law is also to be found in the Advanced Training section. It is not necessary for all employees to receive detailed training, but a general awareness can be obtained by completing the Basic Training course. The more of your employees who complete the training, the greater your risk management will be.
